TERMS OF SERVICE — ILEARNPOLSKI.COM

This is a courtesy translation provided for convenience. The legally binding version of these Terms is the Polish version (Regulamin) available at terms-pl. In case of any discrepancy, the Polish version prevails.

§ 1. General provisions

  1. These Terms define the rules for using the website available at https://www.ilearnpolski.com (the "Service"), the types and scope of services provided electronically (the free Account and the paid Subscription), the conditions for concluding and terminating agreements for those services, and the rules on payments, withdrawal, and complaints.
  2. The Service enables learning Polish at levels A1–B1 through access to educational materials: grammar lessons, exercises, the vocabulary path (Daily Words), listening and reading tasks, speaking topics, and mock exams.
  3. Using the Service requires acceptance of these Terms, which takes place when creating an Account.

§ 2. Definitions

  1. Service Provider — ILearnPolski, e-mail: support@ilearnpolski.com, tel. +48 531 503 579.
  2. User — a natural person holding an Account in the Service.
  3. Consumer — a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code.
  4. Entrepreneur with consumer rights — a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for that person. The provisions of these Terms concerning Consumers with respect to withdrawal, unfair contractual terms, and conformity of the service with the contract apply accordingly to such persons.
  5. Account— a free service provided electronically: the User's individual account created through registration.
  6. Subscription — a paid service granting access to the full content of the Service, automatically renewing, in a monthly or annual variant.
  7. Trial Period — a free, 3-day (72-hour) trial period of the Subscription.
  8. Payment Operator — Stripe, Inc. together with its affiliated companies (including Stripe Payments Europe Limited), handling payments in the Service.

§ 3. Technical requirements

  1. Using the Service requires: a device with Internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active e-mail address.
  2. Listening tasks require audio playback capability.

§ 4. Account — free service

  1. The Account agreement is concluded upon registration (providing an e-mail address and setting a password) and runs for an indefinite period. Registration is free. The Service is intended for persons aged 16 or over; persons under 16 may use the Service only with the consent and under the supervision of a legal guardian who accepts these Terms on their behalf.
  2. The Account includes: access to the User panel, management of settings, and a preview of freely available elements of the Service. Access to the full educational content requires a Subscription.
  3. The User undertakes to provide true information and not to share login credentials with third parties. The Account is intended for the personal use of one person.
  4. The following are prohibited in particular: sharing the Account with others, copying or mass-downloading (scraping) the Service's content, distributing the Service's content, actions disrupting the operation of the Service, circumventing security measures, and providing unlawful content.
  5. In the event of a breach of these Terms, the Service Provider will request the User by e-mail to cease the breach within 7 days. After this period expires without effect, the Service Provider may block or delete the Account. In cases of serious breaches — fraud, threats to the security of the Service, unlawful activity, or gross abuse (e.g. mass copying of content) — the Service Provider may suspend access immediately, informing the User of the reason unless prevented by law or security considerations. The User has the right to file a complaint in accordance with § 8.
  6. If the Service Provider terminates the agreement with a User holding a paid Subscription, the User is entitled to a proportional refund for the unused period. This does not exclude the Service Provider's right to claim compensation for damage caused by the User's breach of these Terms under general rules.
  7. The User may request deletion of the Account at any time by contacting support@ilearnpolski.com. A deletion request automatically cancels the renewal of the Subscription. If a paid billing period is running at the time of the request, the Account remains active until its end, unless the User expressly requests immediate deletion.

§ 5. Scope of the service and changes to the Service

  1. Within the Subscription, the User receives access to all published educational content of the Service for the duration of the Subscription.
  2. The Service Provider may make changes to the content and functions of the Service that are not necessary to maintain conformity of the service with the contract only for justified reasons: security considerations, changes in law, correction of substantive or technical errors, ensuring technical compatibility with devices and browsers, development of teaching methods, and replacement of outdated materials. Such changes are made at no additional cost to the User.
  3. If a change materially and negatively affects the User's access to or use of the service, the Service Provider will inform the User in advance, on a durable medium, of the nature of the change, the date of its implementation, its effect on the service, and the right to terminate the agreement and the deadline for exercising it. In such a case, the User may terminate the agreement without notice within 30 days of the change or of being informed of it (whichever is later), with a proportional refund for the unused period.
  4. The Service Provider strives to keep the Service running without interruption, subject to short technical breaks (maintenance, updates). Users will be informed in advance of planned longer interruptions.
  5. The Service is educational in nature. The Service Provider does not guarantee reaching a specific language level or passing any external examination.

§ 6. Subscription, Trial Period, and payments

  1. The Subscription is available in two variants: monthly — PLN 39.99 and annual — PLN 249.99. Prices are total (gross) prices in Polish zloty.
  2. Ordering a Subscription takes place by selecting a variant in the Service, ticking the required consents, and completing the order process with the Payment Operator, including providing and verifying payment card details. Before placing the order, the User is shown: the selected variant, the total price, information about automatic renewal, the exact date and time of the end of the Trial Period, and the date and amount of the first charge.
  3. The Subscription agreement is concluded upon successful completion of the order process. Promptly after conclusion of the agreement, and before the service begins, the Service Provider sends the User a confirmation of the agreement on a durable medium to the e-mail address provided. Positive verification of the payment card is a technical condition for activating the Subscription. Access to the content begins upon activation of the Trial Period.
  4. Each new Subscription begins with a Trial Period lasting 72 hours from activation. During the Trial Period, the card is not charged. If the User does not cancel the Subscription before the end of the Trial Period, the card is automatically charged the amount of the selected variant after it ends, and then cyclically at the beginning of each subsequent billing period. The exact date and time of the end of the Trial Period and of the first charge are indicated during the order process and in the confirmation e-mail (Central European time — Europe/Warsaw).
  5. The Trial Period is available once — per person, Account, and payment method. If the User is not eligible for the Trial Period, they will be clearly informed of this before placing the order. A paid Subscription may only be started after the User separately confirms an order with an obligation to pay.
  6. Payments are handled by the Payment Operator. The Service Provider does not store full payment card details.
  7. The User may cancel the Subscription at any time through the subscription management panel available in the Service. Cancellation takes effect at the end of the paid billing period — until then, the User retains full access. Cancellation during the Trial Period means the card will not be charged. Cancellation (opting out of renewal) is distinct from the statutory right of withdrawal described in § 7.
  8. In the event of a failed renewal payment, charge attempts may be repeated in accordance with the payment configuration. Access to paid content remains active until the Subscription expires; after unsuccessful charge attempts, the Subscription expires and the Subscription agreement is terminated. No fees are due for periods in which the service was not provided.
  9. The Service Provider may change Subscription prices only for justified reasons: a material change in the costs of running the Service (including infrastructure or third-party licensing costs), inflation, tax or legal changes, or substantial development of the Service's functionality. The Service Provider will give notice of a change by e-mail at least 30 days before it takes effect, indicating the current price, the new price, the date of the first renewal at the new price, and how to cancel. The new price applies only from the next billing period — the price of a paid period never changes. A User who does not accept the change may cancel the Subscription before it takes effect.

§ 7. Right of withdrawal and money-back guarantee

  1. A Consumer may withdraw from the Subscription agreement within 14 days of its conclusion, without giving any reason.
  2. Withdrawing or cancelling during the Trial Period involves no payment — the card has not yet been charged.
  3. If the card has already been charged before withdrawal, the Service Provider refunds the full amount paid (money-back guarantee), promptly and no later than 14 days after receiving the declaration, using the same payment method.
  4. A withdrawal declaration may be made in any unequivocal form, in particular by e-mail to support@ilearnpolski.com, including by using the form in Annex 1. Sending it before the deadline is sufficient.
  5. Nothing in this section limits the Consumer's statutory rights; where they differ, the solution more favourable to the Consumer applies.

§ 8. Complaints and conformity of the service with the contract

  1. Complaints may be submitted by e-mail to support@ilearnpolski.com. A complaint should include the e-mail address linked to the Account and a description of the problem.
  2. The Service Provider responds to a complaint within 14 days of receiving it, on a durable medium (e-mail). Failure to respond within this period means the complaint is deemed accepted.
  3. The Service Provider is liable for the conformity of the digital service with the contract under the rules of the Polish Consumer Rights Act. If the digital service does not conform to the contract, the Consumer may demand that it be brought into conformity. The Consumer may submit a declaration of price reduction or withdrawal from the contract in the cases specified in Article 43n of the Consumer Rights Act, in particular where bringing the service into conformity is impossible or would involve excessive costs, the Service Provider has failed to bring the service into conformity, the lack of conformity persists, is material, or the circumstances indicate that it will not be remedied within a reasonable time or without excessive inconvenience to the Consumer.
  4. A Consumer may use out-of-court complaint and redress procedures, including the assistance of municipal or district consumer ombudsmen or consumer organisations. Information: https://www.uokik.gov.pl.

§ 9. Intellectual property

  1. The content of the Service (lesson texts, exercises, audio recordings, graphics, course structure, software) — to the extent protected under applicable law — is the subject of rights held by the Service Provider or its licensors.
  2. Within the Subscription, the User receives a non-exclusive, non-transferable licence to use the content solely for their own personal educational use, for the duration of the Subscription. This does not limit the User's rights under statutory permitted-use provisions.
  3. Copying, distributing, publicly sharing, and reselling the Service's content is prohibited, as is using the Service's content for text and data mining, including training artificial intelligence systems. The Service Provider reserves its rights to the Service's content with respect to text and data mining within the meaning of applicable copyright law.

§ 10. Liability

  1. Towards Consumers and Entrepreneurs with consumer rights, the Service Provider is liable under the general rules of applicable law; nothing in these Terms excludes or limits their rights under mandatory provisions of law.
  2. The Service is intended for Consumers and Entrepreneurs with consumer rights. Towards other Users, the Service Provider's liability is limited to the amount of fees paid in the 12 months preceding the event and does not cover lost profits; this limitation does not apply to damage caused intentionally or to liability that cannot be excluded by law.

§ 11. Personal data

Information on the processing of personal data, including the controller, purposes, legal bases, and recipients of data, is provided in the Privacy Policy available at https://www.ilearnpolski.com/privacy-pl (English courtesy translation: https://www.ilearnpolski.com/privacy).

§ 12. Amendments to the Terms

  1. The Service Provider may amend these Terms only for important reasons: changes in law or its binding interpretation, compliance with a decision of a competent authority, the need to counteract security threats, changes to the Service Provider's identification or contact details, changes to the Service in accordance with § 5, or price changes in accordance with § 6(9).
  2. Users will be informed of an amendment by e-mail at least 14 days before it takes effect, with an indication of the scope of the changes. A User who does not accept the changes may terminate the agreement (cancel the Subscription and/or delete the Account) before they take effect. Changes affecting rights or obligations arising from a paid Subscription apply at the earliest from the beginning of the next billing period, unless earlier application is required by mandatory provisions of law or necessary to remove an immediate security threat.

§ 13. Final provisions

  1. Polish law applies. The choice of Polish law does not deprive a Consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
  2. Disputes with Consumers are resolved by the courts having jurisdiction under general rules.
  3. These Terms are drawn up in Polish. Translations of these Terms are provided for information purposes only; in case of discrepancy, the Polish version prevails.
  4. Annex 1 forms an integral part of these Terms.
